Man Killed While Working On Plane.

John F. Cox, of Lincoln, Nebraska, was working on a plane that he built when it hit him after he got it started, pushing him into a nearby hangar and killing him.  Apparently, when he got the plane started, it was in full throttle and hit him.

According to authorities, John F. Cox was working on the Titan tornado SS, that was made by and registered to him, at the Beatrice Municipal Airport, in Beatrice, Nebraska, when the plane hit and killed him.  Erin Byrne, the Beatrice Police investigator said that “the plane hit [Cox], pushing him into a nearby hanger.”  A witness told Beatrice Police investigators that Cox was working on the plane, which he had built himself.  He was trying to start the plane, but when he managed to get it started, it was in full throttle and hit him.  The Federal Aviation Administration records show that the plane was, in fact, registered to John F. Cox and that he built it himself.

Kansas Moves to Increase Cap on Personal Injury and Wrongful Death Lawsuit Damages.

The State of Kansas moved one step closer to increasing its cap on personal injury damages and wrongful death damages in personal injury lawsuits following a vote by a committee in its State House of Representatives.

On Tuesday, March 18, the vote by the Commerce, Labor and Economic Committee of the Kansas House of Representatives sent a bill to increase the monetary damages cap to the full House for debate.  Kansas’s current cap on monetary damages for non-economic harm in personal injury cases, which includes damages for pain and suffering, is $250,000, regardless of the extent of the injury.

This cap came under scrutiny in 2012 when the Kansas Supreme Court upheld the cap, but expressed worry that the cap had not been adjusted for inflation since it was made law in 1988, a period of 24 years.  Now, after two additional years, the bill passed by the House Committee aims to raise that cap to $300,000 in July 2014.  The bill also includes language guaranteeing that the cap would increase to $350,000 by July 2022.

In addition to increasing the cap on damages in personal injury lawsuits, the legislation would also revise evidentiary rules in personal injury lawsuits, limiting expert testimony and allowing juries to be informed if a plaintiff has already received monetary compensation from an insurance company.

The Kansas State Senate has already passed the bill.

MBTA Green Line Train Derails Near Kenmore Station Injuring Seven.

The first car of an MBTA Green Line trolley derailed near Kenmore Station during the afternoon of Monday, March 10, 2014, sending seven passengers to the hospital with minor injuries.

While the cause of the derailment has yet to be determined, the first trolley of the D Line trolley veered off the tracks near Kenmore Station where the D and C Lines intersect.  A second trolley had to suddenly apply its brakes to avoid colliding with the derailed trolley, injuring some passengers.  Several injured passengers have reported back pain.

While it is fortunate that nobody was seriously injured, the Green Line derailment disrupted service through Kenmore station, as emergency crews worked around the site of the incident.  Shuttles brought MBTA passengers to and from their desired locations until service resumed.
