According to a recently-filed report from the North Carolina State Highway Patrol, 28-year-old Patrick John Gainey was killed when he was part of a serious motorcycle crash on Highway 152. Gainey, a resident of Kannapolis, North Carolina, was riding his motorcycle east when he crossed the centerline and flew off the road, according to the report. The motorcycle crashed into a trash can and several wooden posts, then stopped on the side of the road. Gainey was declared dead on the scene, and police have suggested that it was a single vehicle accident and no other injuries were reported.

Train Operators Being Sued By Railway Company After Collision Leaves Several Riders Injured.

In accidents involving large companies, we usually expect to see injured parties sue someone on the hierarchy, such as a manufacturer or distributor of a certain product. According to reports, southbound train No. 175 collided with northbound train M47, completely destroying the two locomotives and leaving four people injured. The collision also caused petroleum to be released from the ground, which has triggered environmental and health concerns and forced people in the area to evacuate their homes.

Now, a lawsuit has been filed against Kevin Tobergate and Andrew Hall, both residents of Kentucky who were operating No. 175 on that day. The suit alleges that Tobergate and Hall were negligent in not being on the lookout for signals which would have alerted them to slow down. Their failure to slow down allegedly then resulted in the crash. The suit further claims the two men were negligent in failing to tell the dispatcher that they had used the emergency brake, and failing to alert anyone that they had run through a stop signal. The lawsuit is asking for a judgment against the two men for property damage to the train and to the surrounding area.

Victims Of Colorado Mine Spill Awaiting Payments 3 Years After The Fact.

More than three years have passed since a major mine spill badly polluted rivers in three states. But the federal government still has not paid for damages for any of the victims affected by the event, which ironically was triggered by the Environmental Protection Agency (EPA). An EPA-led contractor crew was doing excavation work at the entrance to the Gold King near Silverton, Colorado, on Aug. 5, 2015, when workers inadvertently unleashed 3 million gallons of wastewater pent up inside the mine.

Pollution then flooded the rivers of Colorado, New Mexico, and Utah, and many tribal lands were affected. Farmers, rafting operators, tour guides, homeowners, and many others were adversely affected by the event, and these groups filed for roughly $318 in economic losses. Although the EPA paid out some money to state, tribal, and local governments for the costs of responding to the spill, no money has been paid to the individual claimants. Initially, the federal government cited sovereign immunity, claiming  that the lawsuits could not be brought in the first place, but then the government said it would review the claims. Still, though, no money has been paid out to date. Claimants from each of the three states affected have also filed separate suits against the EPA.
