According to CNN, the powerful, deadly blasts sent huge plumes of smoke billowing into the sky and shook the ground in neighboring towns. The bodies of 28 people who died have been identified and returned to their relatives. Authorities say it could be days before they can determine the identities of the other seven victims.  Dozens more people have reported injuries ranging from minor to severe, and hospitals and emergency crews are still treating those affected by the explosion.  The exact cause and circumstances of the explosion are still under investigation.

Urologist Settles Personal Injury Lawsuit For $1.4 Million After Failing To Diagnose Kidney Cancer.

Having cancer can involve a long and scary fight.  Fortunately, thanks to advancements in medical treatments and technology, cancer patients have a greater chance now of survival than ever before.  The timing of cancer detection, however, is still a crucial and critical factor in combating the disease.  An early diagnosis, in fact, can be the difference between life and death. The earlier someone’s cancer is discovered and treated, the better the chances of them recovering. That is why it is crucial that doctors do not misdiagnose or ignore the symptoms of cancer; if they do, they may be held liable for medical malpractice resulting from their negligence.

This was the unfortunate position one Massachusetts man found himself after his cancerous kidney mass was repeatedly not properly diagnosed.  The man underwent a routine CT scan in preparation for colon surgery when technicians noticed a mass in his right kidney.  The man was then referred to a urologist who ordered an additional CT scan.  The mass was again shown, but the urologist was not convinced that it was malignant.  The doctor ordered an MRI, and concluded that the man should wait for a “long-term interval follow-up.”

Instead of scheduling a surgery, the urologist chose an “active surveillance” of the man’s kidneys and had him come in for a CT scan every six months.  The patient and his wife asked the urologist to perform a biopsy, but he refused citing a concern that it could do more harm than good. Eighteen months later, the man was diagnosed with a widely metastatic renal cell carcinoma and died three weeks later.

The man’s widow filed a wrongful death and medical malpractice lawsuit against the urologist and the hospital.  Her attorneys, Patrick Jones and Donna Corcoran, argued that the urologist breached his duty of care by failing to properly diagnose the man’s cancer and that his refusal to perform a biopsy was in direct contradiction with modern medicine and appropriate and proper procedures.  The widow ultimately agreed to settle her lawsuit for $1.4 million.

Amtrak Agrees To Pay $265 Million in Personal Injury Damages After Fatal Train Crash.

Trains are essential to modern travel.  They ferry large amounts of goods across the country and assist commuters in getting to and from and around major metropolitan areas.  There is, however, a downside to relying on trains for transportation: most trains carry hundreds of passengers at a time, meaning that an accident or collision can cause injuries to many people. Negligent and careless acts involving trains can thus lead too frequently to serious injury or even death. Every year, about 1,000 people die in train accidents in Massachusetts alone.  If a train accident personal injury is brought about by a conductor’s or other person’s negligence, then the injured victim may have a meritorious personal injury lawsuit to bring.

One of the most severe train accidents in recent history was the 2015 Amtrak Philadelphia crash, which injured dozens and killed eight.  The train was ferrying over 240 commuters when it entered a curve at more than twice the recommended 50 miles-per-hour speed limit; as a result, the train derailed, mangling one car and knocking two others on their sides. 

The victims and their families came together and filed a class-action lawsuit against Amtrak, arguing that its negligence caused the death and injuries of dozens of passengers.  Most likely fearing the outcome of a jury trial, Amtrak agreed to settle the lawsuit out of court.  In December 2015, following the Philadelphia Amtrak crash, Congress raised the damages cap for a single rail accident from $200 million to $295 million.  In order to settle all claims, Amtrak agreed to pay the crash victims and their families a total of $265 million, one of the highest civil awards of its type in US history.
