Jefferson High School, in Jefferson City, Missouri, is currently the target of a lawsuit alleging that it was negligent in allowing a man to pose as a parent in order to remove a student from class. According to the report, the man then sexually assaulted the student, who has elected to remain anonymous. The suit alleges that one of the teachers at Jefferson High School failed to ask the man for proper identification, and did not follow a number of other procedures designed to protect the safety of Jefferson High students. Both district policies and the high school handbook outline various steps that need to be taken before a parent can remove a child from class, and few to none of these steps were taken.

Smith and his family are originally from Florida, and plan to aggressively pursue this claim against the restaurant.
