Family Files Personal Injury Lawsuit Against Ikea After Son Dies From Furniture Accident.

Losing a family member is one of the most tragic things a person can experience.  The feelings of loss and sadness can be compounded when that family member’s death is prematurely caused by someone else’s negligence or wrongdoing.  While nothing can be done to bring back a loved one, a personal injury lawsuit may be a way to hold a negligent party accountable.

Those who wrongfully lose a family member may recover for loss of companionship damages, and sometimes for punitive damages: extra damages for which a person or entity may be held liable that serve as a punishment for particularly egregious misbehavior. In order to receive punitive damages, the plaintiff must show that the defendant’s wrongful actions were intentional, malicious, wanton or grossly negligent. When a loved one has died as a result of someone else’s negligence, it is critical to choose a qualified and experienced Boston, Massachusetts wrongful death lawyer to act on your behalf.

That is precisely what the Collas family is doing after their two-year-old son Curren died in a freak furniture accident while at home.  In February of this year, Curren’s mother, Jackie Collas, went into his room to get him ready for breakfast; she saw that Curren’s dresser had fallen over and that all of its contents were spilled on the floor.  Jackie looked around the room and could not see Curren, and she quickly became nervous.

After several seconds, Jackie began digging through the clothes dumped out of the dresser and found Curren pinned against his bed by the dresser.  She immediately called emergency responders, but Curren had already tragically died. The type of dresser that fell on top of Curren has since been a part of a massive product recall by Ikea, the manufacturer and seller of the dresser.  The dresser was recalled because, due to its design, it allegedly has a tendency to tip over when children attempt to climb it, potentially injuring or even killing them.  Curren’s family has filed a wrongful death lawsuit against Ikea alleging that they were negligent in designing and selling a furniture model with such a high likelihood of harm.

California Woman Fatally Struck by Train That Did Not Stop in Time.

One of the greatest safety drawbacks of a train is its inability to stop quickly in the case of an emergency.  An 8-car passenger train, moving at 80 miles per hour, needs about a mile of tracks to stop.  Because of this, common carriers, such as trains, subways and trolleys, owe a heightened duty of care to their passengers under applicable state and federal law. Therefore, if you are injured due to the negligence of a railway company or operator of a common carrier, you are entitled to receive money damages for their breach of the applicable duty of care.

That is precisely where one California woman’s family finds themselves after she was struck and killed by a train one weekday morning.  The accident occurred in Santa Clara, California at around 8:00 AM at the Santa Clara station at 1001 Railroad Avenue.  According to abc7news.com, the northbound train No. 423 was carrying approximately 125 passengers as it was approaching the station when the woman walked across the train’s path.  The train was unable to stop in time and struck the woman.  Officials are investigating further into the cause and circumstances of the collision.  If the railroad company is found to have been negligent, such as by an inattentive driver or poorly maintained track guards, they may be liable for the woman’s death.

If you or a family member have been injured in a train accident, our Boston train accident attorneys will make sure that you receive all the money damages you are justly entitled to.  Please call 617-787-3700, 24/7, or email us at info@gilhoylaw.com today for your free and confidential consultation.  Time may be a factor, so please call today!

On October 17, 2015, David Schneider and Jerry Allder were traveling in an aircraft from Crete Municipal Airport to Lincoln Airport in Nebraska.  Allder was the pilot and Schneider was the passenger.  Midway through the flight, the plane made low-altitude passes above a small lake on property owned by Allder before ascending after a final pass to 2,000 feet.  Suddenly, the plane plunged nose down and crashed in a field, about 25 miles from Lincoln Airport.  Both Schneider and Allder died in the crash.  Federal investigators found no evidence of engine malfunction of plane failure.

According to journalstar.com, Schneider’s wife has filed a lawsuit against the estate of Allder for negligence and the wrongful death of her husband.  The lawsuit alleges that Allder failed to maintain reasonable control of the plane.  The suit also alleges that Allder was performing aerobatic maneuvers, which violates federal aviation regulations.  Schneider’s wife is seeking $6,000 in funeral and burial expenses in addition to other unspecified damages.
