When engaging in high adrenaline activities such as sky diving or windsurfing, we take on some inherent risk involved in the activity. However, that is not to say that when an accident occurs, there is not some blame to be assigned to someone. After Yu Chen of Madison, Wisconsin was struck by a boat and killed in a recent windsurfing accident, his friends and family were left looking for answers. None of them witnessed the accident, but they all believe that there is some level of fault for the operators of the boat. Although the D.A.’s office has come out and said that there is no basis for criminal charges, Chen’s family will still look to the civil side of the law and file a wrongful death lawsuit in the near future. Even in the absence of drugs and alcohol, Chen’s family is struggling to understand how the boat did not see Chen, and believes that there must have been some degree of negligence that resulted in the 43-year old’s death. Chen’s family is represented by Jay Urban of Urban and Taylor SC of Milwaukee, Wisconsin.
