Eight-Year Employment Suit Hinged On Issue Of Detriment.

A Massachusetts construction manager initiated a lawsuit against his employer after he was fired in 2004.  The construction manager, Henry Suominen Jr., alleged in his lawsuit that his employer had broken an agreement to provide him with certain compensation in addition to his regular salary.  A jury originally found that Suominen relied on the promises made by his employer and awarded him 1.7 million dollars in damages.  Suominen’s employers appealed this decision and argued that Suominen had to prove that he suffered some detriment as a result of relying on his employer’s promises. The appeals court agreed and sent the case back for a retrial in which a second jury found that Suominen had not relied on any promise of his employer to his detriment.
