A female patient suffered nerve damage in her neck after her primary care physician accidentally nicked her right spinal accessory nerve. The personal injuries inflicted were during an excision of a nodule during a visit to the doctor’s office back in 2010.
In June of 2010, the patient visited her PCP, an internist, complaining of pain on the right side of her neck. The doctor diagnosed her with a palpable, non-tender right neck nodule, which he excised in his office the following day. He submitted the excised specimen to pathology for a full work-up.
The patient began complaining of weakness in her right arm and shoulder and difficulty extending her fingers a few days after the procedure. Pathology results indicated that there was nerve tissue bundled in the excised specimen.
A surgeon later operated to repair the woman’s right spinal accessory nerve, which has resulted in some return to normalcy for the woman. However, she still suffers physical impairment and discomfort in her right arm.
The woman received a $400,000 settlement for her medical malpractice injuries after the parties agreed to mediation.
